Abstract

The Venezuelan Constitution of 1999, co-located with the constitutions of Bolivia and Ecuador in what has been called the new Latin American constitutionalism, involved the implementation in the country of a new constitutional model. Fifteen years after its entry into force there are still laws that has not been adapted to the new model, one is the Code of Civil Procedure. Currently, with the aim of solving this mismatch, National Assembly is reforming the code which is expected to be approved before the end of 2015. This paper conducts an analysis of those elements which are used to adapt this rule of civil procedure to the paradigm of the new Latin American constitutionalism and a study of some of the limits and possibilities offered by the new Code.
