Abstract
One of the central topics for legal theory is the analysis of the concept of responsibility. It is a highly controversial notion in normative discourses and ranks among the most challenging to address in law. This essay revisits the reconstruction offered by H.L.A. Hart for two main reasons. The first is general: his analysis is among the most influential on responsibility within the discipline. The second pertains to Hart’s work: his treatment provides a fruitful framework for elucidating the author's theoretical, methodological, or even metaphysical commitments. In particular, I am interested in making a brief foray into the problem of free will and the position defended by Hart. After analyzing and discussing the different senses of the notion identified by the Oxford professor, with special emphasis on responsibility-liability, I conclude with some final reflections.
