Recognition of Diversity: Indigenous Peoples in Voluntary Isolation

Abstract

This review examines the judgment of the Inter-American Court of Human Rights in the case of Tagaeri and Taromenane vs. Ecuador, emphasizing the significance of recognizing indigenous peoples in voluntary isolation (PIAV) through legal means. It highlights the international responsibility of the Ecuadorian State for multiple violations of fundamental rights, in the context of extractive activities and structural omissions. The analysis highlights the tension between development models and collective rights, and proposes an ethical review of the governance regime over indigenous territories. The text emphasizes the need to protect the self-determination and cultural identity of indigenous peoples as a legal and humanitarian imperative.
