Abstract
Pro persona principle is an overarching human rights interpretative procedure which implicates preferring the norm that better protects a human right or the one that less affects it. This article studies pro persona principle in a constitutional and democratic state of law. As well as develops a review in the doctrinal, constitutional and legal regulation and rights adjudication in the mexican and international scope.The authors retain the copyright and must provide in writing the authorization for the first publication, via a computer network and printed to Juridical Science.
