Abstract
Having largely overcome the traditional division between civil and political rights, on the one hand, and economic, social and cultural rights (ESC Rights), on the other, and the current legal recognition of the latter as rights of equal hierarchy and significance, a new space has opened for further analysis of such rights. This article deals with the conceptual evolution and legal framework of ESC Rights in international human rights law, mainly in the United Nations system, through a comparative review of the regional systems in the Inter-American, European and African human rights spheres. In the face of the scandalous reality of poverty and overwhelming global socio-economic inequality, some paradigmatic opportunities that this renewed legal scenario offers are explored, to use these rights as an avenue to achieve socio-economic justice for millions of people in the world, especially those in the most vulnerable and marginalized conditions.
