Résumé
Après avoir largement surmonté la division traditionnelle entre droits civils et politiques, d’une part, et droits économiques, sociaux et culturels (DESC), d’autre part, et la reconnaissance juridique actuelle de ces derniers comme droits de même hiérarchie et d’importance, un nouvel espace s’est ouvert pour une analyse plus approfondie de ces droits. Cet article traite de l’évolution conceptuelle et du cadre juridique des droits ESC dans le droit international des droits de l’homme, principalement dans le système des Nations Unies, à travers une analyse comparative des systèmes régionaux dans les domaines interaméricain, européen et africain des droits de l’homme. Face à la réalité scandaleuse de la pauvreté et des inégalités socio-économiques mondiales accablantes, certaines opportunités paradigmatiques qu’offre ce scénario juridique renouvelé sont explorées, pour utiliser ces droits comme un moyen de parvenir à la justice socio-économique pour des millions de personnes dans le monde, en particulier celles qui se trouvent dans les conditions les plus vulnérables et marginalisées.
